Terms & Conditions

1. Agreement

By purchasing, downloading, installing, or using AutomateFlow (the “Software”), you agree to these Terms & Conditions. If you are accepting on behalf of a company, you confirm you are authorised to bind that company. If you do not agree, do not install or use the Software.

2. What you are buying

AutomateFlow is sold as a one-time licence for the source code of a self-hosted application. After payment, the source package is delivered to your purchase email address. You install and run it on infrastructure you control.

You are buying software, not a hosted service. NetDevGuru Infotech does not host the Software, does not send email on your behalf, and does not operate or monitor your installation.

3. Licence grant

Subject to payment and continued compliance with these terms, NetDevGuru Infotech grants you a perpetual, non-exclusive, non-transferable licence to:

• install and run one production instance of the Software per licence purchased, on infrastructure you own or lease;
• create additional non-production instances (development, staging, testing) supporting that production instance;
• modify the source code for your own use, including to integrate it with your own systems;
• use the Software to send email to contacts you have lawfully collected, and to provide email services to your own customers.

4. Licence restrictions

You may not:

• resell, sublicense, redistribute, publish, or open-source the source code, in original or modified form;
• share, lease, or transfer your licence to another party without our written consent;
• remove or obscure copyright, licence, or attribution notices in the source;
• use the Software to send unsolicited bulk email, or for any unlawful, deceptive, or abusive purpose.

Each production installation requires its own licence. Running the Software for multiple unrelated businesses or clients requires a licence per production instance.

5. Third-party services and costs

The Software depends on third-party services that you contract for separately and pay for directly — including Amazon Web Services (SES, SNS, SQS, Lambda, S3, CloudFront) or an SMTP provider of your choice, and optionally OpenAI and Google APIs. Your use of those services is governed by their own terms. NetDevGuru Infotech is not responsible for their availability, pricing, policy changes, or for suspension of your accounts with them.

Sending costs, hosting costs, and any provider fees are yours. The licence fee covers the Software only.

6. Your responsibilities

You are solely responsible for:

• securing, updating, backing up, and monitoring your installation and its servers;
• the lawfulness of your email sending, including obtaining valid consent, honouring unsubscribe requests, and complying with anti-spam and data protection law applicable to you and your recipients;
• all data you load into the Software, including personal data of your contacts, for which you are the data controller;
• configuring authentication (SPF, DKIM, DMARC) at your DNS and sending provider, and maintaining your own sender reputation.

7. Support and updates

Each licence includes 6 months of support from the date of purchase, covering installation guidance and defects in the Software as supplied. Support is provided by email at netdevguru@gmail.com.

Support does not cover server administration, custom feature development, modifications you have made to the source, third-party service configuration beyond the supplied documentation, or recovery of data. Updates released during your support period are provided at our discretion; there is no commitment to a release schedule or to any future feature.

8. Intellectual property

NetDevGuru Infotech retains all right, title, and interest in the Software, including all copies and derivative works of the source code. This licence transfers no ownership. Content you create with the Software — your templates, campaigns, and contact data — remains yours.

9. Warranty disclaimer

The Software is provided “as is”, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. NetDevGuru Infotech does not warrant that the Software will be uninterrupted or error-free, that it will meet your requirements, or that any particular email deliverability, inbox placement, or engagement rate will be achieved.

10. Limitation of liability

To the maximum extent permitted by law, NetDevGuru Infotech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising from or related to the Software — even if advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Software shall not exceed the amount you actually paid for your licence.

11. Termination

This licence terminates automatically if you materially breach these terms, in particular the restrictions in section 4. On termination you must stop using the Software and destroy all copies of the source code in your possession. Sections 8 through 12 survive termination.

12. Governing law

These terms are governed by the laws of India, and the courts of India shall have exclusive jurisdiction over any dispute arising from them.

13. Changes to these terms

We may update these terms to reflect changes to the product or to legal requirements. The revision date at the top of this page always shows when it last changed. Material changes do not apply retroactively to licences already purchased.
